Terms and Conditions

Last updated: August 28, 2026

These Terms and Conditions govern your use of thebariatricbraininstitute.com and the workshops, coaching services, digital products, educational resources, meetings, and related services provided by Jessica Lawson Enterprises, LLC, doing business as The Bariatric Brain Institute.

By using the website, registering for a workshop, purchasing a product, applying for coaching, or participating in a service, you agree to these Terms. If you do not agree, do not use the website or services.

Educational and Coaching Services

Our services provide education, coaching, tools, and support related to behavior change and life after bariatric surgery. They are not medical care, mental-health treatment, nutrition therapy, diagnosis, or emergency services. Nothing on the website or in a workshop, product, meeting, or coaching service replaces advice from a qualified healthcare professional.

Do not delay or disregard professional medical advice because of information provided by us. Contact an appropriate healthcare professional about medical symptoms, medications, nutrition requirements, or treatment decisions. Call emergency services if you believe you are experiencing an emergency.

Eligibility

The website and services are intended for adults who are at least 18 years old. By using them, you represent that you are legally able to enter into these Terms.

Registrations and Information You Provide

You agree to provide accurate, current information when registering, purchasing, applying, or communicating with us. You are responsible for keeping your email address and other contact information current so that you can receive access details and service communications.

Purchases, Payment, and Access

Prices, payment schedules, and included services are shown at checkout or in a separate written agreement. You authorize the applicable payment processor to charge the payment method you provide according to the terms shown at purchase.

The Food Noise Workshop VIP Pass is a one-time digital purchase, not a subscription. It includes the items described on the order page for that workshop cycle. Access instructions are delivered electronically to the email address connected to the purchase.

If you have an access problem or something is not delivered as described, email [email protected] within seven days and we will make it right. Otherwise, digital purchases are final except where required by law.

Coaching programs, memberships, subscriptions, payment plans, and other offers may have additional payment, cancellation, and refund terms shown at checkout or in a separate agreement. Those offer-specific terms control if they conflict with this general section.

Failure to attend a live workshop or session does not automatically create a right to a refund. Any recording or alternate access is provided only when it is included in the offer description.

Delivery and Technical Access

Digital products and access details are normally delivered by email, a webpage, a client portal, or another electronic platform. Delivery times may vary because of processing, spam filtering, platform availability, or technical issues.

You are responsible for using a supported device and internet connection, checking spam or promotions folders, and contacting us promptly if access does not arrive. We may change the delivery platform or meeting provider when reasonably necessary, provided that we continue to deliver the material or service purchased.

Live Sessions and Recordings

Some workshops, group sessions, or coaching meetings may be recorded. We will notify you before recording begins and obtain consent as required by applicable law. If you consent and remain in the session, the recording may capture your display name, voice, video, questions, or chat messages if you choose to participate in those ways. If you do not consent, do not remain in the recorded session.

You may keep your camera off, change your display name, or refrain from sharing identifying information in a recorded group setting. Do not share another person's private or health information without permission.

Recordings may be made available to eligible purchasers or participants for the access period described in the offer. You may not download, copy, publish, resell, or share a private recording or access link unless we give written permission.

No Guaranteed Results

Results vary from person to person. We do not guarantee weight loss, weight maintenance, changes in food noise, health outcomes, income, or any other specific result. Your results depend on many factors, including your circumstances, decisions, participation, and professional care.

Testimonials and examples describe individual experiences. They are not promises that you will receive the same result.

Intellectual Property

Unless otherwise stated, the website, workshops, recordings, guides, frameworks, worksheets, graphics, videos, text, and other materials are owned by or licensed to Jessica Lawson Enterprises, LLC and are protected by intellectual-property laws.

We grant you a limited, personal, nonexclusive, nontransferable license to use purchased or provided materials for your own individual, noncommercial use. You may not reproduce, distribute, sell, sublicense, publish, upload, teach from, create derivative products from, or share the materials or access credentials without written permission.

Your Content and Participation

You retain ownership of content you submit. You grant us a limited license to host, process, display, and use that content as reasonably necessary to provide the service, respond to you, moderate a group, maintain records, and meet legal obligations.

We will not use your identifying testimonial, image, or personal story in public marketing without permission. Group participants must respect the privacy of other participants and may not record, screenshot, publish, or share another person's comments or identifying information.

Acceptable Use

You may not:

use the website or services for unlawful, fraudulent, abusive, or harmful purposes;

interfere with the website, meetings, accounts, payment systems, or security controls;

attempt to gain unauthorized access to private pages, recordings, accounts, or materials;

upload malware or content that violates another person's rights;

impersonate another person or misrepresent your identity;

harass participants, staff, or service providers; or

share, resell, or redistribute private access links or copyrighted materials.

We may suspend or end access when reasonably necessary to protect participants, enforce these Terms, prevent misuse, or comply with law. Ending access for a material violation does not create a right to a refund except where required by law.

Communications

When you provide contact information, we may send transactional and service-related communications about registrations, purchases, appointments, access, and active programs. Marketing emails include an unsubscribe method where required.

If you separately consent to text messages, message frequency varies and message and data rates may apply. Reply STOP to opt out or HELP for help. Consent to marketing text messages is not a condition of purchase.

Third-Party Services and Links

We use third-party providers for functions such as website hosting, forms, payments, email, text messaging, analytics, scheduling, and video meetings. Your use of a third-party service may also be subject to that provider's terms and policies.

We are not responsible for the content, availability, security, or practices of websites and services that we do not control.

Disclaimer of Warranties

To the fullest extent permitted by law, the website and services are provided on an "as is" and "as available" basis. We do not promise that the website or services will always be uninterrupted, error-free, secure, or suitable for every person or purpose.

Nothing in these Terms excludes a warranty or right that cannot legally be excluded.

Limitation of Liability

To the fullest extent permitted by law, Jessica Lawson Enterprises, LLC and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the website or services.

To the fullest extent permitted by law, our total liability for a claim connected to a paid product or service will not exceed the amount you paid us for the specific product or service giving rise to the claim. This limitation does not apply where liability cannot legally be limited.

Changes to the Website, Services, or Terms

We may update the website, services, or these Terms as our business and legal obligations change. The revised Terms will be posted on this page with an updated date. Changes apply prospectively when posted unless otherwise stated.

Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any mandatory consumer rights available where you live remain unaffected.

Before filing a legal claim, you agree to contact us and make a good-faith effort to resolve the issue informally. Nothing in this section prevents either party from seeking relief in small-claims court when eligible or from pursuing rights that cannot legally be waived.

Severability and Entire Agreement

If a provision of these Terms is found unenforceable, the remaining provisions will continue in effect. These Terms, together with the Privacy Policy and any offer-specific checkout terms or signed agreement, form the agreement governing the applicable website use, product, or service.
